Each voter has two votes. The first vote (Erststimme) is for a candidate in one of the 299 constituencies. The second vote (Zweitstimme) is for a party’s state list, and it decides how many of the seats each party gets. Since the 2023 electoral law, the Bundestag has a fixed size of 630 seats. There are no more overhang or balance seats. A party can win only as many constituency seats as its second votes cover (Zweitstimmendeckung). If a party wins more constituencies in a state than its second votes allow, the constituency winners with the lowest first-vote shares do not get a seat.
Parties need at least 5% of second votes nationwide to win seats. On July 30, 2024, the Federal Constitutional Court ruled that the 2023 law is mostly constitutional, but that the 5% threshold without an exception is currently not. Until lawmakers pass a new rule, the threshold applies with the old exception: a party that wins at least three constituencies still takes part in the seat distribution. Parties of national minorities, such as the SSW, are exempt from the threshold. Bundesverfassungsgericht
